The Website Services Addendum applies to all website plans and managed services.

NovAlign Digital is the trade name of NovAlign Digital Solutions, LLC (“NovAlign Digital,” “Company”).
This Website Services Addendum (“Addendum”) applies to any Client purchasing website-related services from NovAlign Digital, including one-off website projects and recurring website plans. The applicable scope, pricing, and inclusions are defined by the Client’s invoice, proposal, onboarding form, or plan description (collectively, the “Scope”).
NovAlign Digital will provide the website services listed in the Scope. Any request not expressly included in the Scope is considered out-of-scope and may be declined or billed at an additional cost.
Unless explicitly stated in writing, the following are not included:
Client is responsible for providing accurate, complete, and properly licensed materials (including text, images, logos, and data). Client represents that it has the legal right to use all provided materials and agrees to indemnify and hold NovAlign Digital harmless from any claims arising from Client-provided content, including copyright or trademark disputes.
Project timelines depend on Client responsiveness. If requested materials or feedback are not provided within 30 calendar days, the project may be delayed or placed on hold.
Unless otherwise stated in writing, deliverables are considered approved after 30 calendar days from delivery if no consolidated feedback is received. Client agrees to provide feedback in a clear, consolidated manner rather than piecemeal submissions.
Unless otherwise stated in the Scope:
One (1) major revision round is included after the initial draft. The included major revision round is defined as up to sixty (60) minutes of revision work based on one consolidated submission of feedback.
Client must submit consolidated feedback within thirty (30) calendar days of delivery. Feedback provided piecemeal or after the 30-day window may be treated as additional revision requests.
Additional revision time beyond the included sixty (60) minutes may be billed at an additional cost.
For website plan clients, revision limits and response timelines are governed by the applicable plan description. Unused revisions do not roll over beyond the renewal period.
Client may be granted full Administrator access to their WordPress website. Client acknowledges that administrative access carries inherent risk and that changes made by the Client may affect website stability, security, or functionality.
Troubleshooting, restoration, or corrective work required as a result of client-initiated changes is not included and will be billed separately. Training is not included under any plan unless explicitly stated.
Where hosting or maintenance is included in the Scope, NovAlign Digital will manage the hosting environment and routine updates as described. NovAlign Digital does not guarantee uninterrupted service due to factors outside its control, including third-party providers, internet outages, software vendors, or force majeure events.
Plugin and theme licenses purchased by NovAlign Digital do not transfer upon offboarding unless explicitly stated in writing.
Website plans renew according to the billing cycle stated on the invoice unless cancelled prior to renewal. Late or unpaid invoices may result in suspension or termination of services, including website access, hosting, or email functionality.
If Client elects to terminate hosting or exit a website plan and the account is paid in full, NovAlign Digital will provide, upon request:
Third-party licenses paid for by NovAlign Digital do not transfer. No refunds or prorated refunds are issued.
Following termination or non‑renewal, NovAlign Digital retains website files for thirty (30) days. After this period, files may be permanently deleted and recovery is not guaranteed.
Client grants NovAlign Digital the right to display completed websites and reasonable excerpts for portfolio, marketing, and promotional purposes unless confidentiality is requested in writing prior to project commencement.
Calls and virtual meetings may be monitored or recorded for quality assurance, documentation, and training purposes where permitted by law. By communicating with NovAlign Digital via phone or video, Client consents to this policy.
NovAlign Digital shall not be liable for indirect, incidental, consequential, or special damages, including loss of revenue, data, or business. Any liability is limited to the amount paid by Client in the three (3) months preceding the claim.
This Addendum is governed by the laws of the State of Florida.
14.1 Domain Management Dependency
Where domain registration or DNS management is included in a website plan, continued website functionality, hosting, email delivery, and integrations depend on the domain remaining under NovAlign Digital’s management.
If a Client transfers, modifies, or removes domain control without prior written coordination:
NovAlign Digital is not responsible for issues resulting from uncoordinated domain changes.
14.2 Zoho Organization & Email Accounts
Email services provided under a website plan are provisioned under NovAlign Digital’s Zoho organization as part of a bundled managed service.
Client acknowledges that:
14.3 Custom Emails, Licenses & Aliases
Website plans may include a defined number of custom email addresses. These may be configured as separate inboxes (user licenses) or as aliases under a single inbox, based on Client preference selected during onboarding.
Additional inboxes beyond plan limits may incur additional fees. Email aliases do not incur additional cost.
14.4 Offboarding, Email Access & Mailbox Exports
Where email services are provided under NovAlign Digital’s Zoho organization, mailbox data is tied to the organization and cannot be transferred between Zoho organizations by the Client.
Client acknowledges that:
Clients may request a mailbox export prior to the end of their active billing period. Requests must be submitted in writing and are subject to reasonable processing time.
As an alternative, Clients may forward or download specific emails they wish to retain prior to license expiration.
After the billing period ends:
NovAlign Digital is not responsible for data loss where no export request is submitted within the allowed timeframe.
NovAlign Digital’s services rely on third-party platforms and providers, including but not limited to hosting providers, registrars, software vendors, and email platforms. Changes to third-party policies, features, pricing, technical limitations, or availability may require adjustments to service delivery, scope, configuration, or pricing. NovAlign Digital is not responsible for service limitations resulting from third-party platform changes and reserves the right to modify services as necessary to remain compliant or operational.
Where security measures are included in the Scope, NovAlign Digital will implement reasonable safeguards consistent with industry practices. Client acknowledges that security is a shared responsibility. NovAlign Digital is not liable for security incidents, data loss, or compromise resulting from client-managed access, shared credentials, third-party plugins, integrations, configurations, or client-initiated changes.
